Last Updated: January 18, 2025

1. Acceptance of Terms

By accessing this website, submitting a contact form, engaging our services, or making a payment, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please discontinue use of our services.

2. Company Overview

Proton Pebble LLC (“Company,” “we,” “us,” or “our”) is a Wyoming-registered limited liability company providing digital solutions including web and mobile app development, AI automation, e-commerce, and hosting services.

3. Services

  • Custom websites and e-commerce platforms
  • Mobile applications (iOS, Android, React Native)
  • AI agents and business automation tools
  • Consulting, hosting, and lead generation solutions

Software may be distributed via third-party platforms like the Apple App Store or Google Play.

4. Client Data & Accounts

We collect contact information (name, email, phone) via forms. Payments are processed securely via Stripe; we do not store payment data. A customer portal may be launched in the future for client communications and lead tracking.

5. Payments

All fees are invoiced through Stripe. Terms of payment, deliverables, and timelines will be detailed in individual project agreements. Late payments may result in service delays or suspension.

6. Refunds & Cancellations

Due to the bespoke nature of our work, refunds are evaluated case-by-case. Cancellation fees may apply, especially for subscription or retainer-based services. These fees will be disclosed upfront in proposals or contracts.

7. Ownership & Licensing

  • Template Sites: Clients do not own the design or structure of template-based solutions.
  • Custom Builds: Ownership rights may be transferred via written agreement.
  • Proprietary Components: Widgets, integrations, or code libraries created by Proton Pebble remain our intellectual property and may be reused.

8. Domain Registration & Ownership

Domains purchased by Proton Pebble LLC on behalf of a client remain the property of Proton Pebble LLC unless explicitly transferred in writing. By default, domain registration information will reflect Proton Pebble LLC as the legal registrant, and domain management (renewals, DNS settings, etc.) will be handled by us as part of your service package.

Clients may request full ownership and transfer of domain registration upon project completion or termination, subject to:

  • Full payment of all outstanding invoices;
  • A $25 domain transfer administration fee (waived at our discretion);
  • Confirmation that the domain has been active for at least 60 days, per ICANN transfer regulations.

Proton Pebble LLC makes no guarantees about domain availability or long-term exclusivity unless a separate written agreement is in place. Failure to renew domains due to late payment or unresponsive communication may result in service interruptions, for which we are not liable.

9. Maintenance & Support

Ongoing maintenance is available via monthly plans. These include updates, bug fixes, and minor changes. Service-level response times (24–72+ hours) vary based on task urgency and project scope.

10. “As-Is” Disclaimer

All deliverables are provided “as is.” While we follow best practices, we do not guarantee that your software will remain error-free, secure, or compatible over time without ongoing maintenance.

11. Limitation of Liability

To the fullest extent permitted by law, Proton Pebble LLC is not liable for any indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid by you in the six (6) months preceding the claim.

12. Termination

Either party may terminate a project with written notice. Early termination fees and unpaid balances remain the client’s responsibility. We may terminate services for breach, non-payment, or abusive behavior.

13. Intellectual Property

Unless otherwise agreed in writing, all intellectual property created by Proton Pebble LLC remains our exclusive property. Clients may not reproduce or distribute proprietary materials without written permission.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA. Disputes shall be resolved through arbitration or a court in Wyoming, unless otherwise agreed.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Updates will be posted on our website. Continued use of our services implies acceptance of revised Terms.
